UK government blocks Scottish gender-reform bill

Rishi Sunak’s government will block controversial “gender ID” reform legislation passed by Holyrood. This move was described by Nicola Sturgeon as an “all out attack” on the Scottish parliament.

Ministers claimed that the bill would have an “chilling” impact on single-sex venues including schools and adversely affect other protections like equal pay.

Different gender recognition systems north or south of the border could also be at risk of “more fraudulent and ill-intentioned” applications.

Lady Sturgeon, Scotland’s first female minister, promised her government that it would defend the legislation.

She called it “a direct attack against our democratically elected Scottish Parliament”.

It is the first instance that Westminster has used the powers under ‘Section 35’ to prevent a Scottish bill getting royal assent.

Alister Jacques, Scottish Minister, said that those who are going through the process to change their legal sex “deserve respect, support and understanding.”

He claimed that his decision was based “on the consequences legislation on the application equal measures protecting Britain and other subjects reserved”.

He added, “I did not take this decision lightly. The bill will have a major effect on, among other issues, questions of equality across Britain in England, Scotland and Wales. I believe that this is the best and most appropriate course of action.

“Should Scotland’s Government decide to return an amended Bill to the Scottish Parliament for reconsideration, I hope that we can work together to find a constructive path forward that respects devolution as well as the workings of UK Parliament legislation.”

Not all conservative politicians agree with the government’s move.

Sunak was recently urged not to get involved by Jimmy Green, MSP’s Scottish Torre.

In a letter, he stated that the move would be “a gift to independence fans who might accuse me of ripping up The Devolution Settlement” and that the government should not treat trans people “as a political football”.

Three Conservative MPs from MSP will vote on the bill back to December.

Sir Keir Sterner, Labor leader, joined the fray. He stated that 16-year olds should not legally change their sexual habits.

The new law will allow anyone under 16 years old to obtain a certificate of gender recognition without the need for a medical diagnosis.

It will also reduce time spent with the opposite sex prior to making the change, from two years to just three months.

Labor MSPs voted for the bill.

But he promised to eliminate the “insults” that converts face under the current system.

He stated, “There are a handful of people out there that don’t identify themselves with the gender they were raised into.” They have a process that they can go through now.

“There are indignities in the process that could be improved by updating legislation, but what I don’t want to get into is the toxic political football that seems to have become permanent.”

Monica Lennon, a Scottish Labor politician called the UK’s decision “shameful”.

MSP Central Scotland stated that the decision was made “for cynical, political reasons”.

Ms. Lennon stated that it was “a bad time for democracy, for devolution, for human rights”.

“Anyone who thinks that conservatives care about the interests of LGBTQ people or women’s rights is lying to themselves.”

Nancy Kelly, chief executive officer of Stonewall, a leading transgender rights organization, has accused Prime Minister of using transgender lives as a political football.

She said, “This option is nuclear.” This is the first time Section 35 of the Statute of Scotland was used since 1998. It is an unprecedented move that severely undermines the devolution settlement, and will open up the constitutional-diplomatic conflict.
