Matthew Haynes for Mr. and Mrs. Dyer asked Mrs. Justice Hill to find out if Mr Baker had violated the terms and declared it in contempt of court. Mrs. Justice Hill stated that there was “a videotape showing Mrs. Dyer having to deal with the fire”.
“The parties are neighbors. This request of contempt was made against the backdrop of 25 years of harassment by Mr. Baker of Mr. and Mrs. Dyer, since they moved into their home in 1997,” he told the court.
“Historical cases relate to the poisoning of dogs and trees, malicious messages and phone calls, mistreatment of visitors arriving by helicopter (and) rubbish such as tires and Tango cans placed in the field.
“After a period of lull in 2012, matters came to a head on June 6, 2021 when Mr. Baker deliberately set fire to the boundary fence separating the two parties’ properties – and it was by chance that Mrs. Dyer was present to take steps to put it out.”
Lena Mattson for Mr. Baker told the court that Dyers’ claims were “false allegations” and that the facts of this case would still be decided by the district court.
She asked Mrs. Justice Hill for an adjournment of the contempt hearing to the main county court trial. The Dyers are seeking a permanent injunction regarding their fence claims.
The judge granted Ms Mattson’s request and ordered Dyers to pay the costs of the hearing of £6,750. Dyers’ lawyers said their hearing costs were around £20,000.
The neighbors will now meet at court for a full hearing of the dispute.
