David Holes, the assistant director of the first film, has pleaded guilty to negligent use of a deadly gun. Baldwin was practising pulling the gun when Mr. Hales, Mrs. Gutierrez -Reid took care of the gun before they handed it over to Baldwin.

“Mr. Baldwin had no reason to believe there was a live bullet in the gun — or anywhere on set,” Baldwin’s attorney, Luke Nicas, said after the charges were announced, calling it a “terrible miscarriage of justice.”
Nikas stated that he relied on the professionals who were working with him to assure him that the gun didn’t have live ammunition. “We will defend these accusations and we will win.”
District Attorney Carmack Altois stated that the charges against the award-winning star demonstrate that “no one’s above the law and everyone deserves justice.”
She said that while the state will serve Baldwin a court subpoena, no warrant will ever be issued.
