A pervert who repeatedly touched an incoherent stranger in front terrified train passengers escaped prison.
Leon Clarkson (21 years old) was caught putting his hands down the woman’s leggings numerous times on the flight. He then claimed it was his girlfriend when confronted with an anxious traveler.
He then “picked” the woman who had taken a prescription prior to the trip and led her off the train.
Fortunately, a ‘uncomfortable passenger’ texted her boyfriend to tell them what she saw. The police were called and the victim was found unconscious at North Tyneside’s tube station.
Newcastle Magistrates Court was told by Neil Ballister, the Prosecutor, that she learned about what had happened after officers told her.
He said that “She woken up in hospital, only for the police to inform her, after their inquiries,”
According to the court, a passenger on the train claimed that the woman appeared “completely unconscious” without being able to sit up.
She described seeing a man touch her pants, adding: “I don’t think that she could have gotten away without it.”
“She wasn’t in a condition to be content with the situation.”
When he challenged the male witness, he claimed that the victim was his girlfriend. He was also a bit dizzy.
Mr Pallister said: “The witness described how he picked up and carried the complainant to her feet, and then escorted her from the metro train.
A man who saw Clarkson and the victim on the train platform said that the victim seemed “totally confused”.
In a victim impact report, the woman stated: “I took medication before getting to the metro and I don’t remember what happened.”
I was told what had happened by the police who investigated the crime. This made me very sick and anxious.
I didn’t even know who this guy was. I didn’t know what was happening. I was very weak at the time and thought it was terrible that he would do this on a subway infront of other people.
I worry that he will do the same to another weak girl or woman. I now tell drunk girls and women to get home safely whenever I see them. I worry about them.
She added, “I really believe that if he is able to do this in front of witnesses, on a packed subway train, he could do something worse to somebody else.”
Clarkson, a Sunderland resident, has admitted to sexual assault. He had been convicted for committing a sexual act aboard a bus, in violation of public morals.
The judge, Registrar Mr. Tahir Khan KS told him: “The complainant was completely at your mercy and you took advantage of her by touching her when it was clear that she could not give her consent.”
Clarkson’s attorney had stated that Clarkson had learning disabilities and a history with mental health problems. He imposed a three year community order with the requirements for the sex offender program.
Jamie Adams, Clarkson’s lawyer, stated that the long-term approach could help him to recover. Clarkson was “taking lots of cannabis” at time of the attack and was sorry for what he did.
The pervert was required to sign the five-year-old sex offenders registry.
The judge stated that the community ruling was not a “retreat”, and would require a lot more work.
